Paid Advertiser Disclosure

Birmingham Recovery operates on an advertising model. Partner treatment facilities pay fees for advertising placement and referrals. By using this service, you acknowledge and agree that:

• Treatment centers receiving calls are paid advertising partners
• Calls may be routed to facilities that pay for advertising placement
• Calls to specific center listings will be routed directly to those facilities
• General helpline calls are answered by paid advertising partners
• The service receives advertising fees from partner facilities
• Neither this service nor anyone who answers receives commissions based on which provider you choose

No Cost to Callers: There is no cost for calling the helpline or receiving matching assistance. All fees are paid by advertising partner facilities.

No Guarantees or Warranties

Birmingham Recovery makes no guarantees, representations, or warranties regarding:

• Treatment outcomes or success rates
• Specific services provided by partner facilities
• Quality, safety, or effectiveness of partner facilities
• Availability of treatment beds or immediate admission
• Insurance coverage or payment arrangements
• Compatibility or appropriateness of matched facilities

Due Diligence: Individuals are solely responsible for conducting their own due diligence when selecting a treatment facility. This includes verifying credentials, licenses, services, costs, and any other relevant information.

The service is provided "as is" and "as available" without warranties of any kind, either express or implied.

Limitation of Liability

To the fullest extent permitted by law, Birmingham Recovery, its owners, operators, employees, and agents shall not be liable for:

• Actions, omissions, or conduct of partner treatment facilities
• Quality, safety, or outcomes of treatment received
• Medical malpractice or negligence by treatment providers
• Financial losses or unexpected costs
• Damages arising from reliance on information provided
• Delays in treatment placement or facility availability
• Direct, indirect, incidental, consequential, or punitive damages

If any jurisdiction does not allow the exclusion of certain warranties or limitation of liability, the above limitations may not fully apply. In such cases, liability shall be limited to the maximum extent permitted by law.

Maximum Liability: In no event shall Birmingham Recovery's total liability exceed the amount paid by you for the service (which is zero for free helpline calls).

Indemnification

You agree to indemnify, defend, and hold harmless Birmingham Recovery, its owners, operators, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your interaction with partner treatment facilities
• Your violation of these Terms of Use
• Your violation of any applicable laws or regulations
• Your violation of any third-party rights

Arbitration and Dispute Resolution

Arbitration Terms:

• Disputes will be resolved through binding arbitration under the American Arbitration Association rules
• Arbitration will be conducted in Birmingham, Alabama, or remotely at mutual agreement
• Each party will bear their own costs and attorneys' fees
• The arbitrator's decision is final and binding
• You waive the right to a jury trial

Class Action Waiver:
